Ndola magistrate Bubala Sikalunda has sentenced a 38-year-old man of Kabushi township in Ndola to four years imprisonment with hard labour for breaking into a vehicle and stealing a laptop worth K8, 000.
Ms Sikalunda last Friday convicted Joseph Mulenga after finding him guilty of theft from a motor vehicle.
“I find that the witnesses were all credible who gave evidence on what happened on the day in question and that the accused has no defence in the matter.
“From the foregoing, I am satisfied that the accused did take the items from the complainant’s car and I find that the prosecution has proved its case beyond any reasonable doubt hence I find him guilty of the charge and I convict him accordingly,” Ms Sikalunda said.
She sentenced Mulenga to four years imprisonment with hard labour.
In mitigation, Mulenga asked the court not to impose a custodial sentence on him because he is the breadwinner of the family and that he is epileptic.
Mulenga on October 31 this year in Ndola, stole a laptop valued at K8, 000 from Greham Kayovu’s car.
During trial, the court heard that Mr Kayovu parked his car at a shopping mall in Ndola and entered a barbershop to have a haircut.
The court heard that Mr Kayovu did not lock the car because he left someone there.
Mulenga broke into the car and got away with the laptop but that the person Mr Kuyovu left in the vehicle apprehended him.
Mr Kayovu was alerted by the person he left in the vehicle that he had apprehended Mulenga.
The court heard that Mr Kuyovu took Mulenga to Ndola Central Police where he was found in possession of tools which he used to open vehicles.
Mulenga opted to remain silent in defence.
“I have also established that the accused failed to offer any explanation as to how he found himself in possession of tools used for breaking into vehicles,” Ms Sikalunda said.
