A LUSAKA man on Thursday admitted to having a two-year sexual affair with a married woman because she allowed him to have sex with her in the matrimonial home. This is in a matter where Raphael Bwalya sued Dennis Chomba in the Lusaka Boma Court on allegations that he committed adultery with his wife, Lista Manda.
Chomba testified in his defence that Manda had been his girlfriend for two years and that he slept with her several times to a point of ‘impregnating’ her. Chomba said he even used to spend nights at Manda’s matrimonial home and that he never saw anything to show that she was a married woman. But Bwalya said Chomba committed adultery with his wife when he was aware that she was married. Bwalya, who works as a bar man in Lusaka’s Kabwata area, submitted that he married Manda in 2007 but did not pay bride price because he had not met any of her relatives. “I met this woman in a tarven, we got married just like that and we have three children.
This man Chomba comes to my house, the other time I found him drinking and smoking. My wife introduced him as a brother and I believed. But one time, while my wife was pregnant, he claimed that it was his pregnancy then just recently I found him sleeping in our bedroom,” he narrated. Manda also admitted having had a sexual affair with Chomba but that the said baby was not his.
Bwalya was demanding that Chomba compensates him over the adultery. However, principal presiding magistrate Mable Mwaba, sitting with senior court magistrates Miyanda Banda and Dennis Mpundu, dismissed the claim on grounds that Bwalya did not pay dowry for Manda and as such they were just cohabiting.
