The Lusaka Boma Court has heard how a 37-year-old man of Mazabuka had sex with his sister in-law after his wife denied him sex.
This is a case in which Romas Daka, 39, sued Alex Namembo for divorce due to his continued adulterous behaviour after 13 years of marriage.
Daka told the court that she got married to Namembo in 2001 and they have a child together.
She said problems in their marriage started in 2003 when Namembo, while working as a farm manager in Balastone started having an affair.
Daka said Namembo has a child out of wedlock with a woman he dated from 2003 to 2004.
“My husband prefers to spend nights with his girlfriends than with me. We reconciled after I informed his family about his behaviour,”she said.
Daka said Namembo’s behaviour of having extra-marital affairs became worse the family moved to Chirundu. He even began to neglect his family.
Daka also told the court that her younger sister lived with them from 2005.
“My husband was having sex with my younger sister right under my nose, “she said.
Daka said her younger sister changed her attitude towards her by being disrespectful yet she was much younger than Daka.
She said she reported the matter to the police who advised her to ask the sister to move out of the house.
“My younger sister moved to my mother’s place but continued having an affair with my husband. I have received reports of their relationship from friends and family,”Daka said.
To add insult to injury, Daka said when she confronted her younger sister, she admitted having the affair stating that her husband promised to marry her.
“When I confronted my sister about it she admitted having an affair with him adding he promised her marriage and his legal union with me was in the way,”Daka said.
She said Namembo has vowed not to end the relationship which has seen him and Daka being on separation for over a year.
Daka said she was seeking a divorce because she could not take the heart ache anymore.
“We have on many occasions sat down as families to solve problems in our marriage but to no avail. I want the both of us part so that we can go our separate ways because I’m tired,” she said.
But Namembo pleaded with Senior Court Magistrates Daniel Phiri and Pauline Newa not to grant the divorce but give the couple another chance to try and resolve their differences by engaging marriage counselors. He said he still loved Daka.
He blamed his promiscuous behaviour to Daka not according him the respect he deserves as a husband.
The court ordered the couple to divorce with no compensation instructing them to share household goods equally.
Namembo was also ordered to pay K150 as child maintenance on a monthly basis to enable Daka look after the children after she was granted custody.
